Terms and Conditions

The General Terms and Conditions apply to all orders and delivery agreements entered into with Dutchshopper. Please read these General Terms and Conditions carefully before ordering anything through the Dutchshopper website!


Article 1 Definitions:

  • Dutchshopper.com is a website of Expatshopper Bv.
  • Expatshopper BV, including its subsidiaries, insofar as they enter into delivery agreements under the application of these General Terms and Conditions. This includes, but is not limited to:

  • Customer: an individual or legal entity who enters into a delivery agreement with Dutchshopper.
  • Delivery agreement: an agreement for the delivery of one or more products from the Dutchshopper webshop.
  • Product: a tangible object that is the subject of a delivery agreement.


Article 2 Applicability

  1. These General Terms and Conditions apply to all offers, orders, and delivery agreements between the Customer and Dutchshopper, except when explicitly and in writing deviated from by either party.
  2. By entering into a delivery agreement, the Customer acknowledges and accepts the General Terms and Conditions of Dutchshopper. These General Terms and Conditions are accessible to everyone on the Dutchshopper website. Upon request, a written copy of these General Terms and Conditions will be provided to the Customer.
  3. Deviations from the content of these General Terms and Conditions are only valid if agreed upon in writing between Dutchshopper and the Customer. In that case, the provisions of these General Terms and Conditions from which no explicit deviation has been made remain fully in force.
  4. Dutchshopper reserves the right to change these General Terms and Conditions and the content of the website at any time. Essential and important changes will be announced on the Dutchshopper website. The amended General Terms and Conditions apply from the effective date for all existing and future delivery agreements, even if these were concluded before the amendment of the General Terms and Conditions.
  5. If one or more provisions of these General Terms and Conditions conflict with mandatory law, the relevant provision will be replaced by a legally valid provision that most closely matches the intent of the original provision.


Article 3 Offers and delivery agreements

  1. All offers are without obligation and are made in writing subject to availability. The offer is dated and thus clearly determinable. If a product is unexpectedly unavailable, an equivalent product will be added to the order, provided that the Customer has already ordered the relevant product. However, the Customer will not be informed in advance if a product is unavailable.
  2. Dutchshopper is only bound by offers and delivery agreements if the Customer responds - preferably in writing - within thirty (30) days.
  3. Dutchshopper cannot be held to offers and delivery agreements if the Customer, according to standards of reasonableness and fairness and common views in normal social traffic, should have understood that the offer or delivery agreement, or part thereof, contains a mistake or error.
  4. If acceptance deviates on minor points from the offer as included in the delivery agreement, Dutchshopper is not bound by this. The delivery agreement will then not be established according to this deviating acceptance, unless Dutchshopper decides otherwise.
  5. A composite price quotation does not oblige Dutchshopper to deliver part of the items included in the offer or delivery agreement at a corresponding part of the stated price.


Article 4 Third parties

  1. Dutchshopper may use third parties in the execution of a delivery agreement. If these third parties apply additional conditions, this will be explicitly communicated before entering into the delivery agreement.
  2. All rights and claims arising from a delivery agreement in favor of Dutchshopper are also stipulated in favor of the third parties engaged by Dutchshopper.
  3. Despite the above, the General Terms and Conditions only apply to the relationship between Dutchshopper and the Customer, and third parties who are not parties to the delivery agreement cannot derive rights from it.


Article 5 Confirmation

  1. After Dutchshopper has received the order, the customer will receive an order confirmation.
  2. Once Dutchshopper has confirmed payment of the order, the order will be executed. If a product is (temporarily) unavailable, it will be replaced by an equivalent product, provided that the Customer has already ordered the relevant product. However, the Customer will not be informed in advance if a product is unavailable. Dutchshopper reserves the right not to execute payments made, for any reason. Reasons may include problems with product stock, issues receiving an order, or problems completing an order. Other issues may also be reasons to reject an order. The payment will be refunded in that case.
  3. Dutchshopper's administration serves - unless proven otherwise - as evidence of the assignments and payments made by the Customer to Dutchshopper, as well as the deliveries performed by Dutchshopper. Dutchshopper acknowledges that electronic communication can serve as evidence. By accepting these General Terms and Conditions, the Customer also acknowledges this.


Article 6 Prices

  1. All prices listed on the Dutchshopper website are in euros, including the Dutch VAT rate and other taxes and levies, and excluding shipping costs, import duties, and other specific country charges, unless otherwise stated or agreed in writing. No VAT refund applies.
  2. The Dutch VAT rate applies to all products offered on the Dutchshopper website, except for deliveries to countries outside the European Union.
  3. No customs duties or taxes are levied on ordered products within the European Union.
  4. The total amount stated on the invoice of an order is final and includes the prices of the ordered products, their processing, packaging materials, and shipping costs.
  5. Dutchshopper expressly reserves the right to change the prices of offered products and correct any errors, especially when necessary based on legal regulations. If the Customer is disadvantaged by this, the Customer will be notified by email and has the right to cancel their order within the following three (3) working days. Dutchshopper cannot be held liable for any (printing) errors in its prices or conditions.

Article 7 Images and Product Display

  1. We strive to display our products as accurately as possible. However, please note that product images are for illustration purposes only. In some cases, an image may come from the supplier and show an earlier version of the product. The packaging or label may have since been adjusted by the manufacturer. No rights can therefore be derived from the displayed images.

Article 8 Delivery

  1. Dutchshopper will strive to package and hand over the products to the chosen postal organizations PostNL, Fedex, or DPD on the specified shipping date as soon as the order is accepted. These organizations will then deliver the package with the ordered products to the address provided by the Customer. All delivery conditions of PostNL, Fedex, or DPD apply to this delivery agreement, and the shipping time only starts when the package is handed over to PostNL, Fedex, or DPD.
  2. If Dutchshopper deems customer data necessary for executing a delivery agreement, the shipping time only starts after the Customer has provided this necessary data to Dutchshopper.
  3. Dutchshopper is not liable for inaccuracies or incomplete transmission of orders and communications from the Customer to Dutchshopper, unless there is intent or gross negligence on the part of Dutchshopper.
  4. The shipping time indicated on the Dutchshopper website is only an indication and not a guarantee. Packages may experience unexpected delays at postal organizations such as PostNL, Bpost, Fedex, or DPD. Dutchshopper has no control over this and cannot be held liable. Possible delays caused by customs in the relevant country are also the responsibility of the Customer.
  5. Dutchshopper has no control over the actions of foreign postal organizations and cannot influence foreign shipments. Dutchshopper can request PostNL, Bpost, Fedex, or DPD to start an investigation into the status or location of a package. This investigation can take up to three (3) months. Whether Dutchshopper proceeds to full reimbursement of the order depends on the outcome of the investigation.
  6. For shipments outside the European Union, the Customer is responsible for any import duties in their country. Dutchshopper cannot be held responsible for seizure of products due to laws and regulations in the destination country and/or any customs delays. It is the Customer's responsibility to contact their local tax office in advance to determine applicable laws and regulations. Dutchshopper has no control over this and cannot be held liable.
  7. If a package is refused at the border and subsequently returned, Dutchshopper will only reimburse the sales value of the ordered products after the products have been received in good condition by Dutchshopper. Dutchshopper cannot be held liable if a package is lost during return shipment due to failure of a postal organization.
  8. If damage to the product packaging occurs during shipping causing spoilage, the Customer must report this to Dutchshopper within 48 hours. In that case, the Customer should not consume the contents of the damaged products. Dutchshopper cannot be held responsible for consequences if the Customer ignores this advice.
  9. The Customer is obliged to accept the ordered products when they are available at customs or pickup point, or when handed over.
  10. Dutchshopper cannot be held responsible for spoilage or expiration of products because the Customer was unable to pick up or receive them on time or due to any customs delays. Return shipping of spoiled products by Dutchshopper is at the Customer's expense if the Customer provided an incorrect or incomplete address.
  11. If the Customer refuses to accept the products or is negligent in providing instructions or the correct delivery address before shipping, the products will be stored at the Customer's risk. Any costs for reshipping or storage of these products are at the Customer's expense. If the Customer refuses the shipment, the Customer is not eligible for a refund of the purchase amount in the case of food items.
  12. All packages are insured. If a package is lost, Dutchshopper can initiate an investigation with the relevant postal organizations PostNL, Fedex, or DPD. If the investigation shows that the package is indeed lost, the Customer is entitled to a full refund of the invoice amount. The Customer is not entitled to a refund in case of delays at PostNL, Fedex, DPD, or customs.
  13. Orders follow the standard delivery of these parties. This means that delivery will be attempted once at the delivery address. If you are not home, the package will be delivered to the nearest pickup point. In most cases, you can choose an alternative pickup point as the delivery address via the track & trace link before delivery. Orders will then remain at the pickup point for at least one week.
  14. Expected delivery time:
    • 2-4 working days within Europe.
    • 5-10 working days to the USA.
    • 6-10 working days to Asia-Pacific and the rest of the world. You will automatically receive an email with a track & trace code upon shipment, allowing you to track your order and, in most cases, change the delivery time or address to a nearby pickup point.
  15. Track your order:
    • Once your order has been shipped, we will send a shipping confirmation with a track & trace code. You can use this to track the package online. Please note that your order may be shipped in two or more packages. In this case, you will see two or more codes in the shipping confirmation.
  16. What to do if the shipment does not progress?:
    • If it seems that the delivery of your order is taking a long time and does not progress for several days in the track & trace, please contact our customer service immediately via email (info@dutchshopper.com) or via the chat at the bottom left of this page.
  17. Dutchshopper reserves the right to exclude products and countries without giving reasons.
  18. All costs related to the delivery of a package are at the Customer's expense.
  19. Dutchshopper will only send a separate invoice to an address provided by the Customer upon explicit request.

Article 9 Delivery of Frozen Products

  1. Ordering frozen products from Dutchshopper is quick and easy.
  2. Dutchshopper will make efforts to deliver the ordered frozen products to your home within 5 working days. We recommend providing a delivery address where someone is always present to receive the package. If no one is present, the risk of thawed frozen products lies with the recipient.
  3. All frozen products are professionally packaged in special insulated packages. Dry ice is used to keep the products frozen for up to 120 hours.
  4. Although we do our utmost best, unforeseen circumstances may cause your package to be delayed. Therefore, we cannot guarantee that all frozen products will be delivered in perfect condition and frozen. However, our experience shows that 99% of packages are delivered without problems.
  5. When handling and removing dry ice, always exercise caution. Dry ice is very cold. We recommend letting the dry ice evaporate in the box. We are not responsible for damage to products, materials, or property caused by improper use or insufficient precautions. Keep dry ice out of reach of children and ensure it evaporates or is removed in a well-ventilated area.
  6. If the frozen products are delivered thawed, you should keep them refrigerated and consume them within 5 days.
  7. If you have special requests or if a product is not listed on our website, please contact our customer service. For larger orders, you can contact our Sales department, who can advise you further and possibly offer a suitable discount.
  8. To qualify for compensation if the package is delivered thawed, three important requirements must be met: the delivery address must be correct, someone must always be present to accept the package, and the recipient must check the track & trace code daily to intervene in time if the package cannot be delivered.


Article 10 Returns

  1. If the Customer does not wish to accept a product for any reason, the Customer has the right to dissolve the delivery agreement within two (2) days without giving reasons. This must be communicated to Dutchshopper in writing.
  2. Dissolution is only possible for non-food products if the product is undamaged and unused, and in the original packaging. Dissolution occurs by returning the product within fifteen (15) days after receipt, with all return costs borne by the Customer.
  3. The invoice amount will be refunded within thirty (30) days after Dutchshopper receives the dissolution statement, provided the product is returned in good condition. The refund will be made to the same bank account used by the Customer for payment.
  4. This article does not apply to products that cannot be returned due to their nature, such as perishable or time-sensitive products and services.


Article 10 Retention of Title (transfer of risks)

  1. Ownership of a product only transfers to the Customer when all payments under the delivery agreement have been made.
  2. The risk of loss or damage to a product transfers to the Customer at the time of delivery.
  3. The risk of loss or damage to a product that is the subject of the delivery agreement only transfers to the Customer at the time of actual delivery.


Article 12 Guarantees

  1. Dutchshopper gives no guarantees but will refund the invoice amount of a product if the Customer can reasonably demonstrate that the product does not meet expectations.
  2. Dutchshopper guarantees that all delivered products have a valid expiration date of at least four (4) days from the day of shipment, unless otherwise stated. We will do our best to ensure that the products meet the description on our website and at the time of ordering, but minor deviations are possible. Products marked "at own risk" are not reimbursed.
  3. The above guarantee applies during the expected shelf life of the products or until the stated "consume before" date, if applicable.
  4. No guarantee is given on products that have become unusable due to improper use, changes by the Customer or third parties without Dutchshopper's permission, or use for purposes for which they are not intended.
  5. Dutchshopper is not responsible for communicating manufacturer recalls but will try to pass this information on to the Customer as soon as possible.


Article 13: Receipt

  1. As soon as the ordered products have been delivered, or at least within the shortest possible period, the Recipient must check whether the delivery has been correctly executed. The Recipient must verify the quality and quantity of the delivered products to ensure they correspond with the agreements in the delivery agreement or at least meet the standards applicable in normal trade.
  2. Any visible deviations and/or deficiencies must be reported to Dutchshopper by email at info@dutchshopper.com within two (2) days after delivery, stating the order number.
  3. A non-visible defect must be reported to Dutchshopper within five (5) days after receipt, but no later than within the warranty period (the usual shelf life for the product), taking into account the provisions of the previous paragraph. After the warranty period, Dutchshopper has the right to charge the Recipient for all replacement costs - including administrative and shipping costs.
  4. If the Recipient has timely complained in accordance with the above article, the Recipient remains obliged to accept and pay for the ordered products. If the Recipient wishes to return the ordered products, they must first contact Dutchshopper. Returns can only be accepted if Dutchshopper has agreed to this in writing.


Article 14: Complaints

  1. If the ordered products do not meet the Recipient's expectations due to breakage, damage, or incorrect delivery, the Recipient must notify Dutchshopper within two (2) days after receipt of the ordered products. If Dutchshopper does not receive a complaint from the Recipient within the specified period, each delivery is deemed to comply with the order placed.


Article 15: Payment

  1. Payments can be made via iDeal, Visa, Mastercard, PayPal, AliPay, Sofort Banking, Giro Pay, Mister Cash, American Express, or by bank transfer. The processing and shipment of the ordered products only take place after the Recipient has paid the full invoice amount.
  2. If the Recipient chooses to pay by bank transfer, the ordered products will be reserved for eight (8) days. After receipt of the due invoice amount in Dutchshopper's bank account, the ordered products will be shipped to the Recipient as soon as possible. The validity of the delivery agreement expires if payment is not made within the specified period.


Article 16: Copyrights

  1. Dutchshopper reserves all rights and powers granted to it under copyright law.
  2. Dutchshopper owns and holds licenses for all copyrights, databases, applications, trademarks, and other intellectual property that are part of this website. The concept, structure, layout, and design are the exclusive property of Dutchshopper.
  3. The Recipient is not allowed to copy, store, and/or disclose the name, content, and/or layout of Dutchshopper in any way without prior written permission from Dutchshopper.


Article 17: Indemnification

  1. The Recipient indemnifies Dutchshopper against claims from third parties regarding intellectual property rights on materials and/or data provided by the Recipient used in the execution of the delivery agreement.
  2. If the Recipient provides data carriers, electronic files, and/or software to Dutchshopper, the Recipient guarantees that these are free of viruses and defects.


Article 18: Liability

  1. If the products delivered by Dutchshopper are not in good condition, Dutchshopper's liability towards the Recipient is limited to what is stipulated in these delivery conditions under “guarantees”.
  2. If a manufacturer of the delivered products is liable for consequential damage, Dutchshopper's liability is limited to replacing these products or refunding the invoice amount.
  3. The Recipient is personally responsible for their product choice and storage. Dutchshopper is not liable for damage resulting from intent, fault, or culpable behavior, or improper or improper use by the Recipient.


Article 19: Force Majeure

  1. If Dutchshopper faces force majeure, it has the right to suspend the execution of the delivery agreement as long as the situation continues, or at Dutchshopper's discretion, to dissolve the delivery agreement wholly or partially. Force majeure includes what is understood in law and jurisprudence, including but not limited to failures by suppliers or other relations of Dutchshopper, strikes, government measures, customs procedures, terrorist threats or wars, fire, natural disasters, and other situations beyond Dutchshopper's control that prevent its obligations.
  2. Dutchshopper and the Recipient are not obliged to fulfill any obligations if hindered by the mentioned circumstances not attributable to them.
  3. Dutchshopper can also invoke force majeure if the circumstances occur after it should have fulfilled its obligations.
  4. In case of force majeure, Dutchshopper is not obliged to compensate costs or damages to the Recipient.


Article 20: Privacy

  1. During the conclusion and execution of a delivery agreement, Dutchshopper collects personal data of the Recipient, which are recorded in its customer database. The use of this data complies with the Personal Data Protection Act. Dutchshopper's privacy statement details how Dutchshopper handles the Recipient's data and how this data can be viewed or changed.
  2. The data of a Recipient will not be provided to third parties without the Recipient's explicit consent, unless necessary for the execution of the delivery agreement.


Article 21: Disputes

  1. The court in Dutchshopper's place of establishment has exclusive jurisdiction to hear disputes, unless the subdistrict court is competent. Nevertheless, Dutchshopper has the right to submit the dispute to the court competent according to the law.


Article 22: Applicable law

  1. Only Dutch law applies to every delivery agreement and these General Terms and Conditions.
  2. The Dutch text of these General Terms and Conditions prevails over translations thereof.
  3. The applicability of the Vienna Sales Convention is excluded.

Article 23: Payment methods

You can always safely pay your Dutchshopper order regardless of the payment method. Payment is always made via Mollie. The payment method is chosen before confirming your order.
